SME Confirmation Letter for 43B(h) Compliances

For the purpose of compliance with MSMED Act and Section 43B(h) of Income Tax Act, the assessee need to maintain record necessary for the purpose of verification of SME status of their supplier/service providers and payment made to such SMEs. In order to compliance with these provisions, you need to send a letter to the supplier and service provider asking for their MSME status, in response to such letter the supplier will provide those details along with relevant document in the following format:

1. We confirm that the provisions of the Micro, Small and Medium Enterprises Development Act, 2006 (MSME) are applicable to us and our organization falls (as per the Acknowledgement enclosed) under the definition of:

Note:

1) This confirmation letter has to be printed on your company letter head

2) Enclose PAN card copy of the Firm.

3) Please put a Tick in the box [√ ] against the appropriate clause mentioned above.

4) Enclose a copy of the MSME / Udyog Aadhaar certificate in case clause no. 1 is applicable to you.
